By downloading, installing, accessing, or using Fleet GPU (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BCDPRODUCTION ("we," "us," or "our").

2. Description of Service

Fleet GPU is a monitoring application that allows users to:

• Monitor GPU machine status on vast.ai
• View machine performance metrics and statistics
• Receive notifications about machine status changes (Premium feature)
• Track temperature and performance data
• Access runtime statistics and insights

The App connects to vast.ai's API using your provided API key to fetch and display this information.

3. Use at Your Own Risk

You expressly acknowledge and agree that:

• Fleet GPU is a monitoring tool only and does not control or manage your hardware
• Use of the App is at your sole risk
• We provide no guarantees regarding the accuracy, reliability, or completeness of any data
• The App may contain bugs, errors, or inaccuracies
• You are solely responsible for any decisions made based on information from the App

4. No Liability for Hardware or Financial Loss

You acknowledge that monitoring software cannot prevent hardware failures and that the App does not provide any protective measures against hardware damage.

5. Accuracy Disclaimer

Data Sources

All machine data, metrics, and statistics displayed in the App are sourced from the vast.ai API. We do not generate, verify, or guarantee the accuracy of this data.

Statistics Are Estimates

Runtime statistics and metrics provided by the App are estimates based on:

• App polling intervals (typically 15-20 minutes)
• Network availability and latency
• API response times and reliability
• Local device caching

Known Limitations

• Runtime Statistics: Accuracy of ±5-15 minutes due to polling intervals
• Temperature Readings: Provided by vast.ai; we do not verify accuracy or calibration
• Performance Metrics: Based on vast.ai data; may vary from actual performance
• Reliability Scores: Calculated by vast.ai, not by Fleet GPU
• Real-time Status: May be delayed by up to 20 minutes depending on refresh settings

Official Statistics

For official, accurate statistics, always refer to vast.ai directly. The App's statistics should be used for monitoring purposes only and not as authoritative financial or operational records.

6. Requirements and Eligibility

User Requirements

To use the App, you must:

• Be at least 18 years old
• Have a valid vast.ai account
• Have a valid vast.ai API key
• Have a compatible iOS device (iOS 17.0 or later)
• Agree to these Terms and our Privacy Policy

API Key Security

You are responsible for:

• Keeping your vast.ai API key secure
• Using read-only API permissions (strongly recommended)
• Any actions taken using your API key
• Revoking compromised API keys immediately

7. Third-Party Services

vast.ai

This App uses the vast.ai API to fetch machine data. By using the App:

• You agree to comply with vast.ai's Terms of Service and policies
• You acknowledge that vast.ai terms and conditions apply to your account
• You understand that we have no control over vast.ai's services or data

• NOT endorsed by vast.ai
• NOT officially connected to vast.ai in any way
• NOT responsible for vast.ai's services, policies, or actions

8. Premium Subscription

Subscription Terms

• Price: $2.99 USD per month
• Billing: Charged to your Apple ID account
• Auto-Renewal: Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Cancellation: Cancel anytime in App Store account settings
• No Refunds: Refunds subject to Apple's refund policy

Premium Features

Premium subscription includes:

• Unlimited machine monitoring
• Push notifications for machine status changes
• Temperature alerts
• Advanced statistics and insights
• Background monitoring

Free Tier Limitations

Free tier is limited to:

• Monitoring 1 machine
• Basic statistics
• Manual refresh only
• No push notifications

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• IN NO EVENT SHALL BCDPRODUCTION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE)
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless BCDPRODUCTION and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another
• Hardware damage or loss of income related to your vast.ai machines
• Inaccurate decisions made based on App data

11. User Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any security measures or access restrictions
• Share your API key with unauthorized parties
• Use the App to harass, abuse, or harm others
• Overload or interfere with the App's servers or infrastructure
• Violate any applicable laws or regulations

12. Intellectual Property

The App and all its contents, features, and functionality are owned by BCDPRODUCTION and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Modifications to Service and Terms

Service Changes

We reserve the right to:

• Modify or discontinue the App at any time without notice
• Change features, functionality, or pricing

15. Termination

Our Right to Terminate

We reserve the right to terminate or suspend your access to the App at any time, without notice, for:

• Fraudulent or illegal activity
• Abuse of the service
• Any reason or no reason at all

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• You must delete the App from all devices
• Provisions that by their nature should survive termination will survive

16. Dispute Resolution
